Definitions

1. E-Wallet: Refers to the electronic money account created through this Application for the purpose of topping up, paying for goods/services, transferring funds, and conducting other transactions as permitted by the Company, which is under the supervision of BluePay Co., Ltd., the holder of the electronic money service license.
2. Transaction: Refers to any financial operation conducted through the User's E-Wallet.
3. e-KYC: Refers to the electronic Know-Your-Customer process for identity verification as required by regulatory authorities.

User Eligibility and Registration

1. You must be at least 15 years of age and have the legal capacity to enter into a binding contract.
2. You must register and complete the e-KYC process as required by the Company, providing accurate, complete, and current information.
3. Each User is permitted to have only one E-Wallet account.

User's Obligations and Responsibilities

1. You agree to maintain the confidentiality of your password, PIN, and login credentials. You are solely responsible for all activities that occur under your account.
2. You must notify the Company immediately of any suspected unauthorized access to your account.
3. You agree not to use the Service for any unlawful purpose, including but not limited to money laundering, terrorist financing, or fraud.
4. You are responsible for the accuracy of the recipient's details and the transaction amount for every transaction. The Company shall not be liable for any errors resulting from your incorrect data entry.

Transactions and Fees

1. The Company will process transactions based on the instructions received from the User's account.
2. All confirmed transactions are final and cannot be cancelled.
3. The Company reserves the right to set limits on transaction types, such as daily/monthly transfer limits and maximum E-Wallet balance, in accordance with our policies and regulatory requirements.
4. Fees may be charged for certain services, which will be clearly communicated to you.

Suspension and Termination

1. The Company reserves the right to suspend or terminate a User's account immediately and without prior notice if we find that:
2. The User has breached any of these Terms.
3. The User has provided false information during registration.
4. The account is being used for illegal or suspicious activities.
5. It is required by a government or legal authority.

Intellectual Property

1. All content, logos, trademarks, and software within this Application are the exclusive intellectual property of the Company. You may not reproduce, modify, or distribute them without our prior written consent.

Limitation of Liability

1. The Service is provided on an "as is" and "as available" basis. The Company does not warrant that the Service will be uninterrupted, secure, or error-free.
2. The Company shall not be liable for any damages arising from force majeure events, network issues, user device errors, or third-party failures.
3. To the fullest extent permitted by law, the Company's liability shall be limited to the amount of the transaction that is proven to be a direct result of our gross negligence.

Changes to Terms

1. The Company reserves the right to amend or change these Terms at any time. We will notify you of any changes through appropriate channels, such as in-app notifications or email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Governing Law

1. These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts of Thailand.
